How to Evaluate a Developer in Gurgaon Before You Buy

Published 2024-03-04 · NStay Homes

Judge the developer, not the brochure

Many websites publish lists of the "top builders in Gurgaon". These lists are usually compiled from marketing material and award claims, and they rarely tell you the thing you need to know: will this developer deliver this particular project, on time, as approved? A large brand can still have a delayed tower, and a smaller developer can have a clean record. This guide explains how to assess any developer using records you can check yourself.

Why the developer matters so much in Gurgaon

Much of Gurgaon's new housing is sold under construction. You commit money years before possession, so your risk depends on the developer's execution, finances and compliance. Gurgaon has seen both well-run projects and long-stalled ones, and the difference usually shows up in public records before it shows up on site.

A seven-point developer checklist

1. HRERA registration and history

Search the developer's name on the Haryana RERA (Gurugram) website and list all of its registered projects. For each one, note the original completion date, any extensions granted, and whether the quarterly progress reports are filed on time. A pattern of repeated extensions is a warning sign. Our walkthrough on reading a Gurgaon RERA project page shows where to find each item.

2. Delivery record on past projects

Get a list of the developer's completed Gurgaon projects. For each, compare the possession date promised at launch with the date the occupation certificate was actually issued. Visit one or two completed societies and ask residents about construction quality, handover of common areas and how the maintenance agency performs.

3. Approvals for the exact project

Confirm the DTCP licence, the approved building plans and the environmental clearance for the tower you are buying in, not just for the overall site. Licence renewal status matters too. See our guide on DTCP licence renewal and project risk.

4. Financial health

Listed developers publish annual reports, quarterly results and credit ratings, which show debt levels and cash flow. For unlisted developers, look for lender tie-ups (whether banks are approving home loans in the project) and any insolvency or recovery proceedings in the company's name. Under RERA, a share of buyer money must go into a separate project account. Ask how the developer complies with this.

5. Complaints and litigation

Search HRERA orders and consumer forum judgments using the developer's and project company's names. A few complaints are normal for a large developer. What matters is the nature of the complaints (delay, refund, quality) and whether orders are complied with.

6. Land and title structure

Many Gurgaon projects are built under collaboration agreements with landowners or through group companies. Find out which entity holds the licence and which one signs your agreement, and whether the land is mortgaged. Our document verification checklist covers the paperwork.

7. Agreement terms

Compare the builder-buyer agreement with the RERA model agreement. Pay particular attention to the carpet area definition, delay compensation, cancellation terms and any extra charges.

Red flags to watch for

  • Bookings or "expressions of interest" taken before HRERA registration (not allowed under RERA).
  • Pressure to pay more than 10% before a registered agreement for sale is signed.
  • "Assured return" or rental-guarantee promises that are not clearly written into the registered agreement.
  • Project details on the brochure that differ from the HRERA page.
  • Repeated extensions and missing quarterly progress reports.

Frequently asked questions

Is a well-known brand enough to guarantee delivery?

No. Brand size helps with funding and processes, but delivery depends on each project's approvals, finances and execution. Check the specific project's HRERA page and progress reports, whoever the developer is.

Where can I see a Gurgaon developer's RERA history?

On the Haryana RERA website, where you can search projects registered with the Gurugram authority by promoter name. Each project page shows the registration number, completion dates, extensions, quarterly progress reports and related orders.

How can I check whether a developer finished past projects on time?

Compare each project's launch-time promised possession date with the date its occupation certificate was issued. Then talk to residents of completed societies about quality and the handover of common areas.

Should I trust award-based developer rankings?

Treat them as marketing. Awards and portal rankings are not regulatory records. Base your decision on HRERA data, approvals, financial disclosures and delivery history.
