Gurgaon Real Estate for Entrepreneurs: Choosing a Business Space

Published 2023-09-01 · NStay Homes

Choosing a Business Space in Gurgaon

Gurgaon is one of India's main office markets, with large business districts, a deep talent pool and a big flexible-workspace sector. For a founder, that means plenty of choice. It also means it is easy to commit to the wrong kind of space, or to a space that cannot legally be used for your business. This guide matches space options to business stages and covers the legal and cost checks that matter.

The earlier version of this article named specific coworking brands and suggested SEZs offered tax incentives to new businesses. We have removed the brand names to stay neutral, and corrected the SEZ point, since income-tax holidays for new SEZ units ended for units starting operations after March 2020.

Match the space to the stage of your business

Option 1: Coworking and managed offices

Flexible workspaces are widely available in Gurgaon's business districts and along the main corridors. They suit businesses that value flexibility over cost per seat.

  • Check the agreement: lock-in period, notice period, annual escalation, security deposit and what is included, such as internet, power backup, housekeeping and meeting-room credits.
  • Check registration use: if you plan to use the address for company or GST registration, confirm the operator will provide the documents needed.
  • Compare cost per usable seat, not the headline price per desk.

Our article on flexible workspace's share of office leasing shows how important this segment has become.

Option 2: Leasing a conventional office

For established teams, a direct lease in a commercial building or IT park usually costs less per seat over three to nine years, but needs capital for fit-out and a longer commitment.

  • Lease terms: lock-in, escalation (often agreed as a fixed percentage at set intervals), rent-free fit-out period, security deposit, and maintenance (CAM) charges.
  • Area: confirm whether rent is on super area or carpet area, and the efficiency (loading) of the building.
  • Building compliance: occupation certificate, fire NOC, and power and parking allocation.
  • Registration: leases above a certain term need to be registered, and stamp duty applies. Take legal advice on structure.

Option 3: Buying commercial property

Some founders buy a small office or SCO unit to use and hold as an asset. Ownership gives control and can be a long-term investment, but it ties up capital that a young business may need. Before buying:

  • Confirm that the land is licensed for commercial use and that the building has the right approvals. See our guide to DTCP commercial use rules.
  • For under-construction commercial projects, check HRERA registration and progress, as for homes.
  • Be cautious of "assured return" or lease-guarantee offers. Check who is giving the guarantee and how it is secured.

Option 4: Working from a residential property

Running a business from a home is common at the start, but the rules matter. Haryana permits limited professional use of part of a residential property in some cases, for example for certain professionals, subject to conditions and fees. Running a shop, clinic with heavy footfall or office with staff from a residential plot without permission can lead to notices, sealing or reassessment of property tax at commercial rates. Our guide to HSVP rules on professional use of residential property explains the position for HSVP sectors.

Licences and registrations to plan for

  • Trade licence from MCG for many types of business premises.
  • GST registration, using the premises address with proof of right to use, such as a lease or NOC from the owner.
  • Shops and establishments registration under Haryana's labour laws, where applicable.
  • Fire and pollution consents for certain uses.

State incentives

Haryana's Enterprises and Employment Policy, 2020 offers incentives to eligible enterprises, including MSMEs and start-ups, through state schemes. Incentives depend on sector, location category and the scheme in force. Check the current scheme details on the state industries and MSME departments' websites.

A quick location checklist

  • Commute times for your team, including metro or rapid-transport access.
  • Distance to clients, airport and partners.
  • Parking for staff and visitors.
  • Food, banking and other daily services nearby.
  • Reliability of power and internet in the building.

Frequently asked questions

Can I register my company at a coworking address in Gurgaon?

Often yes, if the operator provides the documents needed, such as an agreement and NOC. Confirm this before signing.

Do SEZ units in Gurgaon still get income-tax holidays?

The income-tax deduction for SEZ units was available only to units that began operations on or before 31 March 2020. New units should take advice on any remaining SEZ benefits.

Can I run an office from my residential plot?

Only within the rules. Limited professional use may be allowed in some cases with conditions and fees. Unapproved commercial use can lead to notices and higher property tax.

What should I check before leasing an office?

The lock-in, escalation, CAM charges, super vs carpet area, the building's occupation certificate and fire NOC, parking and power allocation, and whether the lease must be registered.
